General terms of use for Stoneasy.com

 

1.     Registration - access - contact information 

1.1.     

The use of the website www.stoneasy.com (hereinafter: the Website) is subject to prior registration during which a user name and password is to be provided.

 Registration and access to the Website are free of charge.

 1.2.

 The use of the Website is reserved for persons who are legally competent to sign binding contracts. The Website is not accessible to minors (under 18 years of age). If the customer registers as a legal person, the physical person acknowledges that he or she is authorised to bind this legal person to observe these general conditions of use.

 1.3.

 The customer is the only party responsible for any transactions under his or her user name and password on the Website. Stoneasy therefore advises the customer to take all the recommended safety measures to protect this password. The customer is not authorised to allow another person, directly or indirectly, to use his or her account.

 1.4.

 The Dutch text of the general conditions of use is the original text and shall take precedence in the event of ambiguities or contradictions.

  

2.     Applicability

 2.1.     

 These general conditions of use apply to all orders/purchases of products from third-party sellers (other than Brachot Ltd) on the Website. These general conditions of use can be consulted on the Website at any time.

 2.2.

 Any customer who places an order for a product that is offered on the Website by a third party accepts that these general conditions of use are applicable.

 2.3.

 Stoneasy has the right to change these general conditions of use at any time. The amended conditions of use will apply as soon as they are published on the Website. If a customer subsequently places an order for a product offered by a third-party seller, they thereby accept that these amended general conditions of use are applicable. It is therefore recommended to consult these general conditions of use before placing an order for a product from a third-party seller.

 

 3.     Contract arising between the customer and third-party seller

 3.1.

 When an order placed by the customer for a product from a third-party seller is accepted by the latter, the purchase contract arises between the customer and third-party seller. Under no circumstances will Stoneasy be or become a party to this contract.

 3.2.

 In the event of questions and/or complaints regarding the products purchased from the third-party sellers, the customer must always address the third-party seller exclusively and directly.

 Offers placed by third-party sellers are not checked by Stoneasy. Stoneasy does not gain ownership of the products offered on the Website by third-party sellers at any time and is not involved in the transactions between customers and third-party sellers.

 Stoneasy only stores the offers (texts, images etc.) placed online by third-party sellers (hosting service). The customer acknowledges that Stoneasy has no control whatsoever over the quality, conformity and/or reliability of the products offered, sold and/or supplied. Stoneasy cannot be held liable in any way for the fulfilment or non-fulfilment of the contract between the customer and the third-party seller.

 3.3.

 The customer can place an order for a product that is offered on the Website by a third party using the normal ordering process. All order confirmations, invoices, delivery slips etc. are sent exclusively by the third-party seller to the customer. Stoneasy does not intervene in this.

  

4.     Information and use of data

4.1.

 The customer is solely responsible for the accuracy of the information provided during registration.

4.2.

 The customer consents to his/her data being provided to the third-party seller, insofar as this data is necessary for the fulfilment of the order placed/contract concluded. The third-party seller is exclusively authorised to make use of the customer’s data insofar as this is necessary in the context of processing and fulfilling the order/purchase contract.

 Limited sharing of this data is necessary to safeguard the functioning and purpose of the Website.

 

5.     Availability – Limitation of liability

 5.1.

 Stoneasy will apply all reasonable measures to guarantee the continuity of the Website as far as possible.

 If access to and/or the functioning of the Website is disrupted for reasons within (e.g. IT maintenance) or beyond (e.g. technical malfunction) Stoneasy’s control, Stoneasy will inform the users of this as quickly as possible and take every reasonable measure to put an end to this disruption as soon as possible.

 5.2.

 Stoneasy shall under no circumstances be liable for indirect damage, consequential damage or loss (such as, but not limited to, lost time, lost opportunities, loss of data, loss of profit etc.) nor for damage resulting indirectly from the use of the Website (such as, but not limited to, damage resulting from disputes between the customer and third-party sellers).

 

6.     Applicable law

 These general conditions of use are governed by and interpreted in accordance with Belgian law; the courts of Kortrijk are exclusively authorised to rule on all disputes that may arise between the parties concerning the use of the Website.
